Technically, once you terminated your employment the H1B was also terminated (Employer may or may not have informed USCIS of the termination), so you would need new stamping because - it is a new petition

No you may not get a dependent visa for spouse without proof of marriage. You may submit other secondary evidence, like affidavits, but USCIS is very strict about requirement of marriage certificate unless
