18 U.S.C §§ 2257- 2257A certifications require photographers to keep record for visual depictions of actual and simulated sexually explicit conduct of adults in order to protect children from sexual exploitation crimes. This is why you will be required to show proof of age and sign a model release when shooting with a photographer whether it is on a paid or exchange (TFP) basis.
18 U.S.C. § 2251- Sexual Exploitation of Children defines child pornography as any visual depiction of sexually explicit conduct involving a minor (persons under 18 years of age). So, is taking ANY type of nude or topless photo of a minor (even non-sexual such as a nudist photo) illegal, immoral or both? Should minors be allowed to model in lingerie even if it is not sexually revealing?
