Susan, The 15% of gross you are paying the former owner is really a commission payment to him. I would certainly report these payments on a 1099-MISC and deduct as a business expense on your tax return
Hi Jeff, Whenever there is more than one member in an LLC, a partnership tax return (1065) is required to be filed. This even the case in non-community property states. I like LLCs for rental properties
