I am told the vehicle would be insured, however, should there be an accident the car would be covered but since the insurance co. has not been notified of my mothers passing the insurance co is then abt to sue the estate for refund of the damages paid. obviously should there be a serious injury the estate would be in jeopardy

2009-06-10Patrisha10101010No10...The expert brought up an issue I hadn't thought of....what if my former insurance company doesn't defend me, then I have to hire an attorney and pay him/her out of my own funds which I am really low on... when I called the plaintiff's insurance company and spoke with a claims supervisor, I was informed that my former insurance company would have to include me in their defense, but maybe not. Also, this claim is in California and the case was filed in April 2009. Her insurance claims adjuster said she has two years to file a claim to re-open the case. It would be great if it really was December 2008 but being an attorney, she probably knows the statutes. Thanks for the indepth answer....think I better search for a lawyer, just in case.
